Freehold vs Leasehold Title: What Buyers Should Know

The difference between freehold and leasehold land in Kenya, why it matters, and how to check which one you are buying.

When you buy land in Kenya, the title tells you not just who owns the land but how they own it. The two most common forms of tenure are freehold and leasehold. Understanding the difference helps you compare properties properly.

What is freehold?

Freehold (often called absolute ownership) means the owner holds the land without a time limit. As long as the owner complies with the law and pays any applicable rates, the land can be used, sold, charged to a bank or passed on to heirs indefinitely.

What is leasehold?

Leasehold means you hold the land for a fixed period, set out in the lease, from the lessor (often the government or county). Common lease terms are 99 years, though shorter and longer terms exist. When the lease expires, the land reverts to the lessor unless the lease is renewed or extended.

Leasehold land may also come with annual ground rent and conditions on how the land is used.

Under Kenya’s Constitution, non-citizens may hold land only on leasehold of up to 99 years.

For a family home or a long-term asset, many buyers prefer freehold. Leasehold is also common, especially in towns, and can be a good investment, but you should know how many years remain on the lease and what conditions apply.

How to check the tenure

  • Look at the title document itself: it will state whether it is freehold or a lease, and for leases, the term and start date.
  • Do an official land search, which confirms the registered details.
  • Ask your advocate to explain any special conditions.

Questions to ask the seller

  1. Is the title freehold or leasehold?
  2. If leasehold, how many years remain and is ground rent up to date?
  3. Is there an individual title for my plot, or is it still under a mother title?
